Terms of Service

These Terms of Service ("Terms") govern your access and use of the "PictoBingo" application (the "Application"), available as a web, iOS and Android application, as well as all services provided therein, by PictoBingo ("We", "Our", "Us").

1. Acceptance of Terms

By accessing or using the Application, you agree to be bound by these Terms and all documents incorporated by reference herein. If you do not accept all these Terms, please do not use the Application.

2. Description of the Application

The Application is designed to allow users to play interactive games with other users by uploading images representing their choices and creating custom missions. We reserve the right to modify or discontinue any element of the Application or its services at any time, without notice.

3. Authorized Use & Prohibited Activities

You agree to use the Application only as permitted by these Terms and in accordance with all applicable laws and regulations. You expressly agree not to:

• Use the Application for illegal, fraudulent or harmful activities.
• Interfere with the operation of the Application or its servers.
• Attempt to access areas of the Application to which you are not authorized to access.
• Modify or create derivative works based on the Application without our prior written consent.
• Circumvent any technical measures designed to protect the Application or its content.
• Upload, post, transmit or otherwise make available any content that is illegal, harmful, threatening, abusive, defamatory, obscene, vulgar, pornographic, invasive of privacy or violating intellectual property rights (see Section 6).
• Collect personal information about other users without their consent.

4. Intellectual Property

The Application and all its content (including, but not limited to, text, graphics, images, videos, source code) are the exclusive property of Us or our licensors and are protected by intellectual property laws. You do not acquire any property rights to the Application simply by using it. You may not reproduce, modify, distribute, sell or exploit the Application or its content without our prior written consent.

5. Personal Data Protection

Your use of the Application is subject to Our Privacy Policy, which describes how we collect, use and protect your personal information. By using the Application, you consent to the practices described in this policy. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) as well as relevant provincial privacy legislation (e.g., Ontario's Personal Information Protection and Electronic Documents Act, 2000; British Columbia's Freedom of Information and Protection of Privacy Act). You have the right to access your personal information, correct it or delete it, in accordance with Our Privacy Policy.

6. User-Generated Content (UGC)

• Ownership: You retain ownership of the images you upload ("User Content"). However, by uploading User Content to the Application, you grant us a non-exclusive, royalty-free and worldwide license to use, reproduce, modify, distribute, display and create derivative works from your User Content for the sole purpose of operating and improving the Application.
• Responsibility: You are solely responsible for your User Content and all consequences that result from it. We are not responsible for claims relating to your User Content.
• Content moderation: We reserve the right, but have no obligation, to monitor, review and remove User Content that violates these Terms or is otherwise deemed unacceptable. You agree to indemnify us against all claims arising from your User Content.
• Reporting inappropriate content: Users are encouraged to report any inappropriate content they encounter on the Application.

7. Google Analytics & Firebase

We use Google Analytics and Google Firebase to analyze the use of the Application and improve our services. These tools may collect information such as:

• General demographic data (age range, gender, approximate geographic location).
• Type of device used.
• Operating system.
• Pages visited in the Application.
• Actions performed in the Application.

This data is used anonymously and in aggregate to help us understand how users interact with the Application and make improvements. You can control Google Analytics data collection by adjusting your browser settings or by using a blocking extension. 8. Disclaimer

The Application is provided "as is" and "as available", without any warranty of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Application will be available, reliable or error-free.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable to you for any direct, indirect, incidental, special, consequential or punitive damages arising from your use of the Application, even if we have been informed of the possibility of such damages.

10. Applicable Law and Jurisdiction

These Terms are governed by the laws of Quebec, Canada. Any dispute arising from these Terms or your use of the Application will be subject to the exclusive jurisdiction of the courts of Montreal, Quebec.

11. Changes to These Terms

We reserve the right to modify these Terms at any time, without notice. Changes will take effect upon their posting on the Application or by providing you with reasonable written notice. Your continued use of the Application after the effective date of changes constitutes your acceptance of them.
